#BUSHMILLSMOMENTS TERMS

The #BushmillsMoments social media (Facebook, Twitter & Instagram) competition (Competition) is subject to these terms and conditions. In these terms and conditions and marketing materials/advertisements relating to the Competition, Bushmills Irish Whiskey means Proximo Spirits UK Ltd.

There is no entry fee and no purchase necessary to enter this competition. Any individual (Entrant) who, during the Competition Period, posts a photo or video to Instagram, Twitter or Facebook with the hashtag #BushmillsMoments will have the chance to win a Prize. Therefore, the criteria for a successful submission by the Entrant must meet this criteria:

The post is uploaded publicly to Facebook, Twitter or Instagram.

The post contains the hashtag #BushmillsMoments.

The post is uploaded to the Entrant’s timeline or under a @BushmillsIRL competition post.

The Entrant has liked or followed the @BushmillsIRL page on Facebook, Twitter or Instagram.

There will be one competition winner per calendar month. The Competition commences on 7 June 2020 and concludes on 31 December 2020 at midnight (EST) (Competition Period). Bushmills Irish Whiskey may extend the Competition Period at its discretion (Extended Competition Period). Details of any Extended Competition Period will be posted on the Facebook, Twitter and Instagram page. References in these terms and conditions to the Competition Period include any Extended Competition Period (where applicable).

The Competition is only valid during the Competition Period. The Competition details are correct at the time of publication of these terms and conditions but may change (at the discretion of Bushmills Irish Whiskey) at any time. Bushmills Irish Whiskey will post any changes to these details (including these terms and conditions) on its Facebook page.

Entry is only open to residents of the Republic of Ireland and Northern Ireland aged 18 years or over. Employees, contractors, consultants and agents (and their immediate families) of Proximo Spirits Ltd, its licensees and marketers are ineligible to enter the Competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, fiancé, grandparent, step-parent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

After the end of every month, Bushmills Irish Whiskey (at its discretion) will decide the successful Eligible Entrants (Winner) who will be entitled to receive a Prize. The decision by Bushmills Irish Whiskey is final and no communication will be entered into. The Prize is a Personalised bottle of Black Bush. Each entry will be individually judged, based upon individual creative merit. All entries must be an independent creation by the entrant and free of any claims that they infringe any third party rights, including but not limited to intellectual property rights.  Entries must not have been published previously and/or have been used to win prizes in any other competitions. If the Entrant submits a picture, or video, for publication the Entrant confirms that they have the consent of all of the people in the picture or video. If the picture, or video, features a child, or children, the Entrant confirms that they are the parent or guardian of the child, or children, and have the legal right to grant consent (or the parent or guardian of the child, or children, has granted such consent. The Winners will be posted on Facebook and Instagram. They will also be individually contacted via Facebook or Instagram and asked to provide their full name and address for the Prize to be delivered. The Prize will only be delivered to an address in Northern Ireland or Republic of Ireland. No changes may be made to the delivery address after dispatch by Bushmills Irish Whiskey. Where Bushmills Irish Whiskey cannot reasonably contact any Winner within seven days of determining the Winner, the Prize will be forfeited by the Winner to Bushmills Irish Whiskey and the Winner will have no claim or recourse against Bushmills Irish Whiskey. Bushmills Irish Whiskey at its discretion may determine another winner of the Prize. The Prize cannot be exchanged for cash, vouchers or alternative prizes or products.

The Winner agrees to Bushmills Irish Whiskey using his/her first name, photo and nonspecific details for promotional purposes (including but not limited to newsletters, the Website and posts on Facebook, Twitter or Instagram).

This Competition is in no way sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram or any other Social Media platform. All entries submitted become the property of Bushmills Irish Whiskey. As a condition of entering into the Competition, each Entrant agrees to assign all their rights, title and interest (including copyright and any other relevant intellectual property) in and to his/her entry to Bushmills Irish Whiskey.

By participating in the Competition, each Entrant accepts these terms and conditions and warrants that his/her entry/comment does not contain any material that is libellous, defamatory, pornographic, profane or obscene and is not inappropriate, offensive or negative. Bushmills Irish Whiskey reserves the right to remove/delete any entries it considers libellous, defamatory, pornographic, profane, obscene, inappropriate, offensive or negative.

Bushmills Irish Whiskey reserves the right, at any time, to verify the validity of entries and Entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms or conditions.

Except for any liability that cannot be excluded by law, Bushmills Irish Whiskey, its licensees and marketers (including its officers, employees, contractors and agents) exclude all liability (including negligence), for any personal injury, or loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition including, but not limited to, where arising out of the following:

(a) any technical difficulties or equipment malfunction (whether or not under Bushmills Irish Whiskey‘s control);

(b) any theft, unauthorised access or third party interference;

(c) any entry or Prize claim that is late, altered or lost; or

(d) use of the Prize.

IP addresses: when you visit our site, we will automatically receive your IP address, a unique identifier for your computer or other access device. This is statistical data and does not identify you as an individual.

Use of your information: We use your personal data to contact you to notify you about your event registration outcome or if you have won a competition.If you register for an event or enter a competition, any personal information that you share with us will be kept secure and only used in line with the relevant terms and conditions of the event and competition. We may use information to update you on other Proximo Spirits events taking place in Ireland. We may use your data to comply with legal and regulatory obligations.

Data retention, consent and information sharing:

Data retention period: We will continue to process your information under this basis until you withdraw consent or it is determined your consent no longer exists.

Consent: If you no longer wish to receive information from us, you can remove your consent by clicking the unsubscribe link at any time, which exists at the bottom of all marketing emails sent by Proximo Spirits UK or by emailing bushmills@clearboxcommunications.com.

Sharing your information: We do not share your information with third parties.

If, as determined by us, the lawful basis upon which we process your personal information changes, we will notify you about the change and any new lawful basis to be used if required. We shall stop processing your personal information if the lawful basis used is no longer relevant.
